OVERVIEW
Welcome to Drone 55. By accessing or using our website and services, you agree to be bound by the following terms and conditions. Please read them carefully.

SERVICE PROVISION
Drone 55, Inc. ("Drone 55," "we," "us," or "our") provides professional unmanned aerial system (UAS) services, including but not limited to aerial photography, videography, and visual imaging services.

INTELLECTUAL PROPERTY RIGHTS

1. All content, photographs, visual images, and deliverables created by Drone 55 are considered the sole and exclusive property of Drone 55, Inc.

2. Clients are granted a perpetual, worldwide, non-exclusive, non-sublicensable, and non-transferable right to use deliverables without transfer of ownership.

3. Usage rights do not include the right to use photographs/visual images for paid advertising without separate agreement.

4. Copyright remains with Drone 55 for all deliverables.

SERVICE TERMS & CONDITIONS

1. Flight Operations
   All operations comply with Federal Aviation Administration (FAA) regulations and Title 14 CFR part 107.

2. Maximum flight altitude: 400 feet above ground level (AGL), except when:

   • Operating within a 400-foot radius of a structure (not to exceed 400 feet above structure's uppermost limit)

   • Operating under a specific Certificate of Authorization (COA)

3. All operations maintain Visual Line of Sight (VLOS) unless authorized by specific COA.

Safety Protocols

1. Drone 55 reserves the absolute right to:

   • Ground aircraft

   • Discontinue flights

   • Modify flight plans

   • Abort operations

2. Safety restrictions apply during unsafe flight conditions, including but not limited to:

   • Winds exceeding 10 mph

   • Poor visibility conditions

   • Adverse weather

   • Any conditions deemed unsafe by our operators

3. All persons must maintain a 25-foot minimum distance from:

   • Small UAS equipment

   • Take-off and landing zones

   • Flight crew members

   • Control stations

Service Delivery

1. While clients may participate in the creative process, Drone 55 maintains final discretion over all technical and creative aspects, including:

   • Color correction

   • Content selection

   • Composition

   • Technical execution

2. Due to the inherent nature of UAS operations, certain variations in visual outcomes are expected and accepted.

3. Subcontractors may be utilized while maintaining full responsibility for deliverable quality.

PAYMENT & CANCELLATION

1. All sales are final and retainers are non-refundable

2. Cancellations require 48-hour notice

3. Additional charges apply for late cancellations, including:

   • $500 daily rescheduling fee

   • Service fees

   • Travel expenses

   • Other applicable costs

LIMITATION OF LIABILITY

1. Drone 55's total liability for any claims arising from services is limited to the payments received for the specific service in question.

2. We make no guarantees regarding:

   • Specific creative outcomes

   • Weather conditions

   • Flight permissions from third parties

   • Temporary Flight Restrictions (TFR) or NOTAMs

INDEMNIFICATION
Clients agree to defend, indemnify, and hold harmless Drone 55, its affiliates, officers, directors, agents, and employees from any claims, damages, or expenses arising from:

1. Client's use of services

2. Breach of agreement terms

3. Property access disputes

4. Privacy claims related to approved flight paths

GOVERNING LAW
This agreement is governed by California law, with Los Angeles County courts having exclusive jurisdiction over any disputes.

CHANGES TO TERMS
Drone 55 reserves the right to modify these terms at any time. Continued use of services following changes constitutes acceptance of modified terms.
